Prior to the 341 (creditors meeting), the Jacksonville Chapter 7 and Chapter 13 Trustee will have a phone conference with your bankruptcy attorney and you regarding any questions the Trustee has regarding your bankruptcy petition or the documents that you provide. Before you are able to receive your Florida bankruptcy discharge, these documents must be reviewed to evaluate your qualifications for bankruptcy relief. Below is a lengthy list of the documents that must be produced to the Trustee prior to that meeting. It is our policy that we collect and review these documents prior to filing. Ideally, these documents should be available
- Financial Accounts
- Copies of Statements for 6 months prior to filing the petition.
- All personal and business accounts (checking, savings, etc.)
- All stock/brokerage accounts including: Retirement plans, pensions, 401 (k)’s, Keogh’s, IRA’s, and Profit Sharing Plans.
- Motor Vehicles (including boats)
- Complete description of all motor vehicles not subject to lease including year, make, model, mileage, and overall condition, picture of vehicle, and copies of the following:
- Title to all motor vehicles owned free and clear.
- Registration to all vehicles subject to lien.
- Purchase and Sale Agreement for any vehicle purchased less than 1 year prior to filing the petition.
- Current payoff statement for any vehicle subject to lien.
- Insurance Coverage
- Copy of insurance declarations page for the following:
- All motor vehicles including boats, trailer’s, etc.
- Homeowner’s or Renter’s insurance.
- Any additional riders for jewelry, electronics, etc.
- Income Verification
- Complete copies of all tax returns, including all Schedules and W-2’s, 1099’s, etc. for tax years 2005, 2006, 2008, when filed.
- Copies of all your pays stubs for the six months prior to filing.
- Domestic Support Obligations
- If you owe any outstanding child support, alimony or other DSO regardless if current or not, provide name, address, and phone number of each recipient. This includes amounts that are deducted from your paycheck for support. Please also include copy of court order requiring you to pay support obligations.
- Real Estate
- Copy of any deeds, notes, mortgages, and tax assessments for all real estate including homestead property.
- Other Documents
- Copies of worksheet or other method used to determine the figures submitted to the court for the means test especially for line 12: 14b; and supporting documentation for questions 37, 38, and 39 if applicable.
- Copy of Social Security Card, and Driver’s License or other Photo Identification for each person who filed the petition.
- Home and work telephone numbers at which you can be contacted.
- Copy of a credit report.
- If divorced within 4 years of filing, copy of the following:
- Dissolution of Marriage
- Any Property Settlement Agreement
- Financial Affidavits
- Qualified Domestic Relations Order
- All documents supporting security interest listed on Schedule D that you filed with the Court (if not already provided under Motor Vehicles or Real Estate sections).
- Documents supporting any amounts owed to you buy third parties (i.e. accounts receivable, mortgage receivable, note receivable, personal injury claims, other lawsuits, trust, etc.)
Finally, if you received a tax refund for 2008 or 2009 prior to filing the petition and it was greater than $2,000.00 OR 2008 tax stimulus check more than $1,500.00, an accounting of the funds including copies of any receipts for major purchases (over $500.00) have to be produced.
